Our Services: An Overview
ParkingPerks provides consumers with access to a free SMS-based perks and offers program ("Perks Program") tied to parking locations operated by or affiliated with ParkingPerks ("Parking Locations"). By registering your mobile number at any ParkingPerks location, you agree to the following Terms and Conditions.
ParkingPerks is a software and marketing platform — not a parking management company or parking enforcement company. At some Parking Locations, ParkingPerks processes parking payments directly within our registration flow. At other locations, you may be redirected to a third-party parking operator's payment system to complete your parking transaction. In either case, ParkingPerks is not responsible for the parking fees, enforcement, or policies set by third-party operators.
Joining the Perks Program is always free. Parking fees, where applicable, are separate and will be disclosed before any charge is made.
1. The Perks Program
1.1 The Perks Program is free to join. There is no membership fee, subscription, or purchase required to register your mobile number and receive offers.
1.2 By registering your mobile number at a ParkingPerks location, you agree to receive SMS messages from ParkingPerks containing offers, deals, event invitations, and other communications from ParkingPerks and its merchant partners.
1.3 By optionally providing your email address, you unlock an additional tier of offers, including city-wide deals and early-access event notifications. Providing your email is voluntary.
1.4 ParkingPerks reserves the right to modify, suspend, or discontinue the Perks Program or any offers at any time without notice. Offers are subject to availability and the terms set by individual merchant partners.
1.5 Perks, offers, and deals delivered through the program are provided by third-party merchant partners. ParkingPerks is not responsible for the fulfillment, accuracy, or availability of any specific offer. Any dispute regarding a redeemed offer should be directed to the merchant.
2. Parking — Fees and Payment
2.1 Parking at ParkingPerks locations may be free or fee-based, depending on the location, time of day, and applicable parking policies. Scanning a QR code and registering your number does not constitute payment of any parking fee.
2.2 Where ParkingPerks collects parking fees directly, all applicable charges will be clearly disclosed before you are asked to provide payment information. You are responsible for reviewing and confirming the fee before completing the transaction.
2.3 At some locations, ParkingPerks will redirect you to a third-party parking operator's payment system to complete your parking payment. In those instances, the third-party operator's terms, pricing, and refund policies govern the transaction. ParkingPerks is not the merchant of record for those transactions and bears no liability for them.
2.4 Where ParkingPerks is the merchant of record, no refunds will be issued for incorrect license plate information, duplicate registrations, unused parking time, or early departure. You are solely responsible for entering accurate vehicle and payment information.
2.5 ParkingPerks does not guarantee the availability of parking at any location. Parking is first-come, first-served.
2.6 ParkingPerks is not a parking enforcement company and does not assess parking citations, violations, or penalties. You are solely responsible for complying with all posted parking rules, signage, and restrictions at any Parking Location. Any parking penalties are your sole responsibility to resolve with the relevant authority.
3. SMS Messaging and Communications
3.1 By registering your mobile number with ParkingPerks, you expressly consent to receive recurring automated SMS text messages from ParkingPerks, including perks offers, merchant promotions, event notifications, and program updates.
3.2 Message and data rates may apply. ParkingPerks is not responsible for any charges assessed by your mobile carrier in connection with receiving SMS messages.
3.3 You may opt out of SMS communications at any time by replying STOP to any ParkingPerks text message. After opting out, you will no longer receive perks offers or program communications. You may re-register at any ParkingPerks location to re-enroll.
3.4 Opting out of SMS messaging does not delete any personal information ParkingPerks has collected. See Section 6 (Privacy Policy) for data deletion requests.
3.5 ParkingPerks cannot guarantee the delivery of SMS messages. Delivery depends on your mobile carrier, network availability, and device settings. ParkingPerks is not liable for undelivered messages or any consequences resulting from non-receipt.
4. Restrictions and User Conduct
4.1 The Perks Program is for personal, non-commercial use only. You may not use ParkingPerks to resell, transfer, or exploit offers for commercial gain.
4.2 You agree to provide accurate and truthful information when registering your mobile number, including your vehicle information where applicable.
4.3 You will not use ParkingPerks in any manner that violates applicable federal, state, or local laws or regulations.
4.4 You will not attempt to reverse engineer, interfere with, or disrupt any component of the ParkingPerks platform, including its QR code system, SMS infrastructure, or payment processing.
4.5 ParkingPerks reserves the right to terminate your enrollment in the Perks Program at any time, without notice, for any violation of these Terms.
5. Parking Safety
5.1 You park at your own risk at any ParkingPerks Parking Location. ParkingPerks is not responsible for damage to your vehicle, theft of your vehicle or its contents, personal injury, or any loss arising from your use of a Parking Location under any circumstances, including fire, weather, theft, vandalism, or acts of God.
5.2 Never leave children or pets unattended in a parked vehicle.
5.3 Always lock your vehicle and remove valuables before leaving your car.
5.4 ParkingPerks assumes no responsibility for your personal safety or the safety of your vehicle at any Parking Location.
6. Privacy Policy
6.1 Information We Collect
When you register with ParkingPerks, we collect the following information:
Mobile phone number (required)
Email address (optional, for enhanced perks)
Vehicle license plate number (where applicable for parking)
Device and usage data (IP address, browser type, interaction data) via cookies and similar tools
6.2 How We Use Your Information
We use your information to:
Deliver SMS perks, offers, and program communications
Process parking payments where ParkingPerks is the payment processor
Share anonymized, aggregated data with merchant partners (never your personal information without consent)
Improve the platform and personalize your experience
Comply with applicable law and respond to lawful requests from authorities
6.3 How We Share Your Information
Merchant Partners: ParkingPerks shares only anonymized offer redemption data with merchant partners. Your phone number and email are never shared with merchants without your explicit consent.
Third-Party Parking Operators: Where you are redirected to a third-party payment system, that operator receives only the information necessary to process your parking transaction, governed by their own privacy policy.
Legal Compliance: We may disclose your information when required by law, subpoena, or governmental authority.
We will never sell your personal information to third parties.
6.4 Data Security
ParkingPerks uses industry-standard security measures to protect your personal information. However, no data transmission over the internet can be guaranteed 100% secure. You provide information at your own risk.
6.5 Your Rights
You may request access to, correction of, or deletion of your personal information by contacting us at privacy@parkingperks.co. Deletion of your information will result in termination of your Perks Program enrollment.
6.6 Cookies
ParkingPerks uses cookies on its web properties to improve functionality and track usage. You may disable cookies in your browser settings, though doing so may affect your experience.
7. Disclaimers and Limitation of Liability
7.1 The Perks Program and all associated offers are provided "as is" and "as available" without warranty of any kind. ParkingPerks makes no representation that any specific offer will be available, honored, or of any particular value.
7.2 To the maximum extent permitted by law, ParkingPerks's total aggregate liability to you for any claim arising out of or related to these Terms or your use of the Perks Program shall not exceed $10.00.
7.3 ParkingPerks is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Perks Program or any Parking Location.
8. Governing Law and Dispute Resolution
8.1 These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
8.2 Any dispute arising under these Terms shall be submitted to binding arbitration administered by a mutually agreed arbitrator under the rules of the American Arbitration Association. Arbitration shall take place in Atlanta, Fulton County, Georgia.
8.3 You agree that claims may only be brought in your individual capacity and not as part of a class action. You waive the right to a jury trial.
8.4 Any claim must be filed within one (1) year of the event giving rise to the claim.
9. Changes to These Terms
ParkingPerks reserves the right to update or modify these Terms at any time. The current version will always be available at parkingperks.co/terms. Your continued use of the Perks Program after any modification constitutes your acceptance of the updated Terms.
